1. Agreement to Terms

By using BananaBot ("the Bot"), you agree to these Terms of Service and our Privacy Policy. If you disagree with any part, do not use the Bot.

2. Description of Service

BananaBot provides:

• AI-powered image generation using text prompts
• Image editing and fusion capabilities
• User galleries to store generated images
• Credit system for premium features
• Referral program for earning bonus credits

3. User Accounts & Eligibility

Requirements:

• Must have valid Discord account
• Must be 13+ years old (or age of consent in your jurisdiction)
• Must comply with Discord's Terms of Service
• One account per user

Account Security:

• You're responsible for your account activity
• Report unauthorized use immediately
• We may suspend accounts for policy violations

4. Usage Rules & Restrictions

Prohibited Content:

• Sexually explicit, violent, or illegal imagery
• Harassment, hate speech, or discriminatory content
• Copyrighted material without permission
• Content violating Discord's Community Guidelines

Usage Limits:

• Free tier: 6 regular generations + 1 fusion (lifetime)
• Rate limits may apply to prevent abuse
• Credit system governs premium usage

Prohibited Activities:

• Attempting to bypass usage limits
• Sharing accounts or transferring credits
• Reverse engineering or exploiting the Bot
• Automated/bulk usage without permission

5. Content & Intellectual Property

Your Content:

• You own the prompts you submit
• You're responsible for ensuring prompts don't violate rights
• Grant us license to process prompts for image generation

Generated Images:

• Images generated belong to you
• Subject to limitations of underlying AI model licenses
• Use responsibly and in compliance with applicable laws

Our Content:

• Bot code, features, and design are our intellectual property
• BananaBot name and branding are our trademarks

6. Payment & Credits

Credit Purchases:

• Processed securely through Stripe
• Credits are non-transferable and non-refundable
• Prices subject to change with notice

Refund Policy:

• Credits generally non-refundable once purchased
• May provide refunds for technical issues on case-by-case basis
• Contact support for refund requests

Referral Program:

• Earn credits by referring new users
• Subject to anti-abuse measures
• May be modified or discontinued at any time

7. Service Availability

No Guarantee:

• Service provided "as is" without uptime guarantees
• May experience downtime for maintenance or issues
• Features may be modified or discontinued

Third-Party Dependencies:

• Relies on Discord, Google Gemini, and other services
• Service may be affected by third-party outages
• Not responsible for third-party service failures

8. Limitation of Liability

Disclaimer:

• Service provided "as is" without warranties
• No guarantee of image quality or generation success
• Not liable for lost data or service interruptions

Liability Limits:

• Maximum liability limited to amount paid in last 12 months
• Not liable for indirect, consequential, or punitive damages
• Some jurisdictions may not allow liability limitations

9. Privacy & Data Protection

• Data handling governed by our Privacy Policy
• We implement reasonable security measures
• Cannot guarantee absolute security
• Report security issues promptly

10. Termination

By You:

• Stop using the Bot at any time
• Remove Bot from your servers
• Contact us to delete your data

By Us:

• May suspend/terminate accounts for violations
• May discontinue service with reasonable notice
• Will attempt to preserve user data when possible

11. Changes to Terms

Modifications:

• May update terms as needed
• Will post changes with updated date
• Continued use constitutes acceptance
• Material changes will be communicated clearly

12. Dispute Resolution

Governing Law:

• Governed by laws of Quebec, Canada
• Disputes subject to jurisdiction of Quebec courts

Communication:

• Attempt to resolve disputes through direct communication
• Contact support before pursuing legal action

13. Miscellaneous

• Severability: If any provision is invalid, remainder stays in effect
• Entire Agreement: These terms constitute the complete agreement
• No Waiver: Failure to enforce rights doesn't waive them
